1. Eligibility and acceptance

You must be at least 13 years old to use the Service. If the law where you live requires a higher age to consent to a digital service, you must meet that age or use the Service only with valid permission from a parent or legal guardian. You represent that you can enter into these Terms and will comply with applicable law.

2. What the Service provides

LoseWeight lets you submit meal photos or text, receive AI-assisted food and nutrition estimates, save meal history, set weight-related goals, and access free or paid features. Features may vary by region, device, app version, or subscription status.

3. Nutrition estimates and no medical advice

Food recognition, serving size, calories, macronutrients, and recommendations are estimates. AI systems can make mistakes, and photos or descriptions may not contain enough information for a reliable result. Do not rely on LoseWeight for medical decisions, emergencies, diagnosis, treatment, medication, allergies, eating disorders, pregnancy, or management of a health condition.

Consult a qualified healthcare professional before making material diet, exercise, or weight changes, especially if you have health concerns. If you believe you have a medical emergency, contact local emergency services.

4. Accounts and devices

The Service may use an anonymous user or device identifier instead of a traditional username. You are responsible for keeping your device and access credentials secure and for activity associated with your account. Do not attempt to access another user’s data. Contact us promptly if you suspect unauthorized access.

5. Your content

You retain ownership of photos, text, and other content you submit. You grant LoseWeight a limited, non-exclusive, worldwide license to host, copy, process, transmit, and display that content only as needed to provide, secure, troubleshoot, and improve the Service, comply with law, and fulfill your requests. This license ends when the content is deleted, except for limited backups and legal or security retention described in the Privacy Policy.

You confirm that you have the rights and permissions needed to submit content and that it does not violate law or another person’s privacy or intellectual-property rights.

6. Acceptable use

You may not:

• Use the Service for unlawful, fraudulent, harmful, or abusive activity.
• Upload malware, illegal content, or content that infringes others’ rights.
• Probe, disrupt, overload, bypass, or reverse engineer security, usage limits, or access controls, except where law expressly permits.
• Use automated means to scrape the Service or create excessive requests without written permission.
• Misrepresent AI estimates as verified medical or professional advice.

7. Apple subscriptions, trials, cancellation, and refunds

LoseWeight may offer monthly and yearly auto-renewing subscriptions. Prices, billing periods, included features, and any introductory offer are shown before purchase and may vary by country. If offered at checkout, a yearly subscription may include a seven-day free trial.

• Payment is charged to your Apple account after you confirm purchase.
• Unless you cancel in time under the terms shown by Apple, the subscription automatically renews and Apple charges the applicable renewal price.
• You can manage or cancel from your Apple ID subscription settings. Cancellation takes effect at the end of the current paid period unless Apple states otherwise.
• If you do not want a trial to convert to a paid subscription, cancel before the deadline Apple shows for that offer.
• Deleting the app or your LoseWeight account does not cancel your Apple subscription.
• Use Restore Purchases in the app to restore eligible access. Refund eligibility and decisions are governed and handled by Apple; submit refund requests directly to Apple.

Your purchase is also subject to the Apple Media Services Terms and the purchase terms displayed by Apple. If those mandatory platform terms conflict with this section, the platform terms control for billing and refunds.

8. AI outputs and feedback

AI output may be inaccurate, incomplete, or similar to output provided to others. You are responsible for reviewing results before relying on them. If you send feedback or suggestions, you allow us to use them without obligation to you to improve the Service, but this does not transfer ownership of your meal photos or other user content.

9. LoseWeight intellectual property

The Service, including its software, design, branding, and non-user content, is owned by LoseWeight or its licensors and is protected by applicable law. Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the app for its intended purpose.

10. Changes and availability

We may update, add, remove, or discontinue features and may perform maintenance. We do not promise uninterrupted or error-free availability. Where required, we will provide notice of material changes that adversely affect a paid subscription and any remedy required by law.

11. Suspension, termination, and deletion

You may stop using the Service at any time and may delete your account in the app. We may restrict or suspend access when reasonably necessary to protect the Service or users, investigate misuse, comply with law, or address a material breach of these Terms. Where practical and legally permitted, we will give notice and an opportunity to address the issue.

Sections that by their nature should survive termination—including ownership, payment obligations already incurred, disclaimers, and liability limits—will survive. Account deletion is handled as described in the Privacy Policy.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” LoseWeight disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that nutrition estimates, AI output, or weight outcomes will be accurate or suitable for you. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

13. Limitation of liability

To the maximum extent permitted by law, LoseWeight will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from use of the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid LoseWeight through the App Store during the 12 months before the event giving rise to the claim or US$50.

These limits do not apply to liability that cannot be limited under applicable law, including where relevant liability for fraud, willful misconduct, or death or personal injury caused by negligence.

14. Applicable law and disputes

Applicable law, including mandatory consumer-protection law where you live, governs these Terms. Nothing here deprives you of rights or forums that cannot be waived. Before starting a formal dispute, please contact vokie123@gmail.com so we can try to resolve the issue informally.

15. Changes to these Terms

We may update these Terms as the Service or law changes. We will post the updated Terms here, change the date above, and provide additional notice when required. If you do not agree to revised Terms, stop using the Service and cancel any subscription before its next renewal.

16. General terms and contact

If a provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a business reorganization or sale, subject to applicable law. These Terms and the Privacy Policy are the agreement between you and LoseWeight concerning the Service, together with mandatory Apple purchase terms.

5. 你的内容

你保留对所提交照片、文字及其他内容的所有权。你授予 LoseWeight 一项有限、非独占、全球范围的许可，仅为提供、保护、排查和改进服务、遵守法律及完成你的请求而托管、复制、处理、传输和展示该内容。内容删除后，该许可终止，但《隐私政策》中说明的有限备份、法律或安全保留除外。

你确认自己拥有提交内容所需的权利和许可，且内容不违反法律或他人的隐私权、知识产权。

6. 可接受使用规则

你不得：

• 将服务用于违法、欺诈、有害或滥用活动。
• 上传恶意软件、违法内容或侵犯他人权利的内容。
• 探测、干扰、过载、绕过或逆向工程安全措施、使用限制或访问控制，但法律明确允许的除外。
• 未经书面许可，使用自动化方式抓取服务或制造过量请求。
• 将 AI 估算歪曲为经核实的医疗或专业建议。

7. Apple 订阅、试用、取消与退款

LoseWeight 可能提供按月和按年自动续订订阅。价格、计费周期、包含功能及任何优惠会在购买前展示，并可能因国家或地区而异。如果购买页提供，年度订阅可能包含 7 天免费试用。

• 你确认购买后，款项将从 Apple 账户扣取。
• 除非你在 Apple 显示的期限内及时取消，否则订阅会自动续订，Apple 将按适用的续订价格扣款。
• 你可以在 Apple ID 的订阅设置中管理或取消。除非 Apple 另有说明，取消将在当前已付费周期结束时生效。

8. AI 输出与反馈

AI 输出可能不准确、不完整，或与提供给其他人的输出相似。你有责任在依赖结果前进行核查。如果你提供意见或建议，即允许我们在不对你承担义务的情况下将其用于改进服务；但这不会转移你对餐食照片或其他用户内容的所有权。

9. LoseWeight 知识产权

服务中的软件、设计、品牌及非用户内容由 LoseWeight 或其许可方所有，并受适用法律保护。在遵守本条款的前提下，我们授予你一项个人、有限、可撤销、非独占、不可转让的许可，以按预定用途使用 App。

10. 变更与可用性

我们可能更新、新增、移除或停止功能，也可能进行维护。我们不承诺服务始终不中断或无错误。如法律要求，我们会对对付费订阅造成不利影响的重大变更作出通知，并提供法律要求的补救。

11. 暂停、终止与删除

你可以随时停止使用服务，并可在 App 中删除账户。为保护服务或用户、调查滥用、遵守法律或处理对本条款的重大违反，我们可能在合理必要时限制或暂停访问。在实际可行且法律允许的情况下，我们会通知你并提供处理问题的机会。

按其性质应在终止后继续有效的条款仍然有效，包括所有权、已经产生的付款义务、免责声明及责任限制。账户删除按照《隐私政策》处理。

12. 免责声明

在法律允许的最大范围内，服务按“现状”和“可用”状态提供。LoseWeight 不作适销性、特定用途适用性、不侵权及准确性的默示保证，也不保证营养估算、AI 输出或体重结果准确或适合你。本条款不排除法律上不得排除的保证或消费者权利。

13. 责任限制

在法律允许的最大范围内，LoseWeight 不对因使用服务产生的间接、附带、特殊、后果性或惩罚性损害，或利润、数据、商誉或机会损失承担责任。对于与服务有关的索赔，我们的责任总额不超过以下两者中的较高者：引发索赔的事件发生前 12 个月内你通过 App Store 向 LoseWeight 支付的金额，或 50 美元。

上述限制不适用于适用法律不得限制的责任，包括在相关地区因欺诈、故意不当行为或因过失造成人身伤亡而产生的责任。

14. 适用法律与争议
